Definitions

"Sterling", "we", "our", "us" refers to Sterling Estate Solutions Ltd, registered in England and Wales (Company No. 12345678).

"Client" refers to any landlord, tenant, property owner, or individual engaging our services.

"Services" refers to all property management, letting, guaranteed rent, construction, and related services.

Landlord Obligations

Landlords must ensure their property meets all applicable safety standards, including Gas Safety certificates, EICR, EPC, and appropriate insurance.

Landlords must disclose any known defects, provide accurate ownership information, and comply with mortgage lender or leasehold conditions.

Tenant Obligations

Tenants must provide accurate information in applications. False or misleading information may result in tenancy termination.

Tenants are required to pay rent on time, maintain the property, report maintenance issues promptly, and comply with all tenancy agreement terms.

Fees & Payment

Management fees are typically deducted from rental income before disbursement. Additional charges for maintenance or compliance will be communicated and approved beforehand.

Tenant fees comply with the Tenant Fees Act 2019: refundable deposits (capped at 5 weeks' rent), holding deposits, and charges for early termination or lost keys as permitted by law.

Guaranteed Rent Scheme

Landlords receive rental income on a set date each month, regardless of tenant occupancy. The guaranteed rent amount, schedule, and duration are specified in the individual agreement.

Landlords must grant Sterling full management authority for the duration. Sterling reserves the right to adjust guaranteed rent at each renewal based on market conditions.

Construction & Refurbishment

All construction works are subject to a separate works agreement. Quotations are valid for 30 days. Final costs may vary due to unforeseen structural issues or client-requested variations.

Sterling obtains all necessary planning permissions and certifications. All works are guaranteed for 12 months from completion.

Termination

Either party may terminate a management agreement with written notice as specified (typically 2 months). Outstanding fees remain payable upon termination.

For guaranteed rent agreements, early termination by the landlord may incur an early exit fee as specified in the agreement.

Limitation of Liability

Sterling shall not be liable for indirect or consequential damages. Total liability shall not exceed fees paid in the preceding 12 months.

Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded by law.

Dispute Resolution

Parties should first attempt informal resolution. Unresolved disputes may be referred to The Property Ombudsman or Property Redress Scheme.

These terms are governed by the laws of England and Wales with exclusive jurisdiction of the courts of England and Wales.
